Terms of Service

These Terms govern the use of the Ondasend app by Shopify merchants. By installing or using Ondasend, you agree to them. If you do not agree, do not use the app.

1. The service

Ondasend lets you create and automate email, WhatsApp and SMS campaigns, segment contacts by behavior and purchase history, recover abandoned carts and track real-time reports, integrated with your Shopify store.

2. Account and eligibility

You need an active Shopify store and authority to install apps and manage its data. You are responsible for your account's security and for activity performed by the app on your store.

3. Plans, billing and free trial

Billing is processed through Shopify Billing: the plan price is shown for approval on install and added to your Shopify invoice. There is a free trial; afterward, recurring billing begins unless canceled. WhatsApp and SMS sends use prepaid credits, non-refundable after sending. Refunds, where applicable, follow Shopify's policies.

4. Acceptable use and anti-spam

  • Send messages only to recipients who gave consent (opt-in);
  • Include a clear unsubscribe method and honor requests;
  • Comply with data-protection and anti-spam laws (LGPD, GDPR, CAN-SPAM) and the policies of Shopify, Meta/WhatsApp and SMS providers;
  • Do not send illegal, deceptive, offensive content or content that infringes third-party rights.

You are solely responsible for your message content and your contacts' consent. We may suspend the service for misuse or breach of these terms.

5. WhatsApp and SMS messaging

WhatsApp and SMS use is subject to provider policies (Meta WhatsApp Business and SMS providers), including template approval, sending windows and opt-in rules. Non-compliance may cause the provider to block the channel, beyond our control.

6. Data and privacy

Data processing is governed by our Privacy Policy. For your customers' data, you are the Controller and Ondasend is the Processor.

7. Intellectual property

The app, its brand and code belong to Ondasend. We grant you a limited, non-exclusive, non-transferable license to use the service while your subscription is active. Content you create remains yours.

8. Availability and disclaimer of warranties

The service is provided "as is", without warranty of uninterrupted or error-free operation. We rely on third parties (Shopify, Amazon SES, Neon, Meta and SMS providers) whose downtime may affect the app.

9. Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect damages, lost profits or data loss. Our total liability is limited to the amount paid for the service in the 12 months before the event.

10. Cancellation and termination

You can cancel anytime by uninstalling the app; billing stops and data is deleted per the Privacy Policy. We may terminate access for breach or legal requirement.

11. Changes to these terms

We may update these terms; continued use after an update constitutes acceptance.

12. Governing law

These terms are governed by the laws of Brazil, with the user's domicile as the venue where required by consumer law.
